The Chartered Institute of Arbitrators London Branch, the Energy Arbitration Club and Herbert Smith Freehills Kramer LLP are delighted to invite you to a panel discussion on Environmental, Social, and Governance (“ESG”) and Climate Considerations in Commercial Arbitration, kindly hosted by Herbert Smith Freehills Kramer LLP in London.
While much attention has been given to the role of government and civil society in disputes with corporate actors on ESG and climate issues, the role of such issues in business-to-business disputes arising within contractual frameworks is often overlooked. In this panel, we will consider how arbitral tribunals are being asked to rule on important ESG and climate issues, how businesses are finding themselves in conflict with their suppliers, counterparties and contractors on these issues, and how contractual language is an important site for managing risk on this front.
